Terms of use

By using this website or placing an order, you agree to these terms. If you do not agree with them, please do not use the site. These terms are between you and [ADD: registered business name] ( “we”, “us”, “Poko Pet”).

You need to be at least 18, or have permission from a parent or guardian, to place an order.

• An order is an offer to buy. It is accepted when we confirm it by email, or when the item ships — whichever comes first.
• We can decline or cancel an order, and will refund you in full if we do. Reasons include a product being unavailable, a suspected fraudulent order, or an obvious pricing error.
• Obvious pricing errors. If something is listed at a clearly wrong price, we are not obliged to sell it at that price. We will contact you and either honour the correct price with your agreement or cancel and refund.
• Prices are shown in the currency displayed at checkout. Taxes and shipping are calculated at checkout. Import duties on international orders are your responsibility.

Personalized products are made individually for you from what you upload, which makes them different from stock items in a few ways that matter.

• Check your spelling. Names and engraving text are reproduced exactly as you enter them. We do not correct what you type.
• The proof step. Where a product includes a proof, nothing is printed, engraved or stitched until you approve the artwork. Approving a proof confirms the design is what you want.
• Production takes time. Each product page states its own production window. That is time to make the item, before shipping.
• Handmade variation. Colours on screen differ from colours in print, and made-to-order items carry small natural variations. That is not a fault.
• Mixed orders arrive separately. An order combining stock items and made-to-order items ships in more than one parcel.

This is the important one, so it is in plain words.

• You keep ownership of your photo. It stays yours. We do not claim it.
• You give us permission to use it to make your item. By uploading, you grant us a limited, non-exclusive licence to store, reproduce and adapt the photo purely to produce, proof and fulfil your order, and to keep it for the retention period in our privacy policy. That licence covers nothing else.
• We will not use your photo in marketing without asking. If we ever want to, we will ask you separately and you can say no.
• You confirm you have the right to upload it. You must own the photo or have permission from whoever took it. Professional pet photographs are usually owned by the photographer, not the pet owner. If a claim is made against us because you did not have the rights, you are responsible for it.
• We can decline content. We may refuse anything unlawful, offensive, or infringing someone else's rights, and refund you rather than make it.

Our refund and cancellation terms are set out in the refund policy shown at checkout, which forms part of your purchase agreement. Please read it before ordering, particularly if you are buying a personalized item.

Nothing in these terms removes any statutory rights you have that cannot be excluded — including rights relating to goods that are faulty, damaged, or not as described.

Delivery estimates are estimates, not guarantees, and do not include delays outside our control such as carrier problems or customs. Responsibility for the goods passes to you on delivery.

Please read this even though it is a legal page, because it is the part that affects an actual animal.

• No pet toy is indestructible. Supervise play, and retire any toy once it is damaged or pieces come loose.
• Choose the size rated for your pet. A toy sized for a larger breed can be a choking hazard for a smaller one.
• Toys are not food, not chew-proof, and not a substitute for veterinary advice. If your pet swallows part of one, contact a vet.
• You are responsible for supervising your pet. We are not liable for injury caused by misuse, an unsuitable size choice, or continued use of a damaged toy.

The Poko Pet name, logo, mascot, illustrations, photography, text and site design belong to us and are protected by copyright and trade mark law. You may not copy, resell or reuse them commercially without written permission. Browsing, sharing links, and normal personal use are fine.

Please do not:

• Break the site, probe it for vulnerabilities, or try to get at data that is not yours.
• Scrape it at a scale that degrades it for other people.
• Use it to do anything unlawful, or to impersonate someone else.
• Place fraudulent orders.

We can suspend access for any of the above.

The site is provided as-is. We work to keep information accurate and the site available, but we do not promise it will be uninterrupted, error-free, or that every description is free of mistakes.

To the fullest extent the law allows, our total liability for any claim connected to an order is limited to what you paid for that order, and we are not liable for indirect or consequential losses. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.

We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top of this page shows when it last changed.

These terms are governed by the laws of [ADD: state / country whose law governs, e.g. California, USA], and disputes will be handled by the courts there. If you are a consumer, this does not deprive you of protections available under the law of the country you live in.
